3. Service Appointments and Scheduling

  • Appointments must be scheduled in advance and are subject to availability
  • We reserve the right to reschedule appointments due to emergency situations or unforeseen circumstances
  • Cancellations must be made at least 24 hours in advance; late cancellations may be subject to fees
  • Access to the service location must be provided at the scheduled time

4. Pricing and Payment

  • Prices for services are as quoted at the time of service request
  • We reserve the right to adjust pricing with notice
  • Payment is due upon completion of services unless other arrangements have been made
  • We accept various payment methods as indicated at the time of service
  • Late payments may be subject to interest charges and collection fees
  • Estimates are not binding; final costs may vary based on actual work required

5. Customer Responsibilities

You agree to:

  • Provide accurate and complete information about your service needs
  • Ensure safe access to the work area
  • Secure pets and remove valuable or fragile items from work areas
  • Disclose any known hazards or special conditions
  • Be present or arrange for authorized representation during service calls
  • Notify us immediately of any concerns during or after service

6. Warranties and Guarantees

  • We guarantee our workmanship for the period specified in your service agreement
  • Manufacturer warranties on parts and equipment are passed through to customers
  • Warranty does not cover damage resulting from misuse, neglect, or unauthorized repairs
  • To maintain warranty coverage, recommended maintenance must be performed

7. Liability and Indemnification

Element Service Group maintains appropriate insurance coverage. We are not liable for:

  • Pre-existing conditions not disclosed at the time of service
  • Damage resulting from customer negligence or misuse
  • Indirect, consequential, or incidental damages
  • Delays or failures due to causes beyond our reasonable control

Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim.

8. Emergency Services

For emergency services, additional fees may apply. Emergency service calls are prioritized based on severity and availability. Response times are estimates and not guaranteed.

9. SMS Text Messaging Communications

By opting in to receive text messages from Element Service Group, you agree to the following terms:

Consent

You must provide consent by checking the SMS consent checkbox on our contact or booking forms. By opting in, you confirm that you are the subscriber or authorized user of the mobile number provided and that you are authorized to consent to receive text messages at that number.

Types of Messages

You consent to receive text messages including:

  • Service plan and membership expiration reminders
  • Special offers and discounts
  • Seasonal service specials
  • Exclusive deals and promotions

Message Frequency

Message frequency varies based on your service activity, up to a maximum of 4 messages per month.

Costs

Message and data rates may apply depending on your carrier plan. We do not charge for SMS messages.

Opt-Out

You may opt out at any time by replying STOP to any message. Upon opting out, you will receive a confirmation and no further messages will be sent.

Consent to receive text messages is not a condition of purchasing any goods or services.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carrier Compatibility

SMS services are compatible with all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Element Service Group or its licensors and is protected by copyright and trademark laws.

11. User Conduct

You agree not to:

  • Use our services for any unlawful purpose
  • Interfere with or disrupt our services or systems
  • Attempt to gain unauthorized access to our systems
  • Harass, threaten, or abuse our staff or representatives
  • Provide false or misleading information

12. Termination

We reserve the right to refuse service or terminate our relationship with any customer who violates these Terms, engages in abusive behavior toward our staff, or fails to meet payment obligations.

13. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree to litigation.

14. Governing Law

These Terms are governed by the laws of NC, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Element Service Group regarding the use of our services, superseding any prior agreements.
